These Terms of Service ("Terms") are, exclusively and in full, governed by and interpreted in accordance with the federal laws of United Arab Emirates and jurisdiction of the Courts of Dubai, and apply to the website drbimal.com ("Website").1.2
The Website is owned and operated by Humanthropy FZCO ("we", "us", "our", "company"), for strictly non-commercial use by the person accessing the Website ("you", "your", "yours", "customer"). Please read these Terms carefully, as they govern our relationship with you and your use of the Website. Please also note that we reserve our right to update these Terms at any time, at our sole discretion and without giving reason or prior notice.1.3
We offer Lifestyle Coaching, as stated on our Trade License (License Number 20791, issued by Dubai Integrated Economic Zones Authority). Whilst we understand this title covers a broad scope of activity, we accept no liability whatsoever for any action or inaction taken by you, or any third-party, as a direct or indirect result of your interactions with us.1.4
Any and all information you provide in your interactions with us must be true, complete and correct. Please refer to our Privacy Policy (privacy.drbimal.com) for details on how we collect and process your data.

Section 2
Visiting the website2.1
In accordance with our Privacy Policy (privacy.drbimal.com), we will not store your browsing data, or use it for marketing purposes, or share it with any third-party.2.2
In continuing to access the Website, you confirm that you are over 21 years old and not under the care of any parent or guardian.2.3
The Website and its contents are for informational purposes only, and do not constitute any form of contract or binding agreement between us. Nonetheless, in continuing to access the Website, you agree to comply with our Terms of Service and Privacy Policy (together as "Legal Terms"). If you do not agree to our Legal Terms, do not access, view, or otherwise use any of our services or register with us.2.4
All content on the Website, including but not limited to the overall "look and feel" of the Website, remains in perpetuity the intellectual property of Humanthropy FZCO. You may not copy or distribute any part of the Website or any of its contents. You may not attempt to impersonate or plagiarise Humanthropy FZCO, or our staff and services, under any circumstance.2.5
Neither the contents of the Website, nor our services, are intended in any way to constitute emergency support, medical or non-medical advice. In case of an emergency, we shall not be able to respond to you and you must contact the appropriate emergency services. Never disregard professional medical advice or delay seeking it because of something you have encountered on our Website, or via any of our services.

Section 3
Sending an email3.1
When you contact us via the email address on the Website, you agree that we may securely store your email communication, including your name, email address and message, for a minimum of seven years. Please be aware that we will store such information locally on our Apple devices, and on the cloud-based servers we use for email.3.2
Whilst we will endeavour to keep all email communication from you strictly confidential, we cannot guarantee to do so. Confidentiality may be compromised where UAE law and/or International law mandates, or in cybersecurity attacks and other data breaches. Please evaluate these and any other possibilities carefully, prior to contacting us via email.3.3
We will not use any aspect of your email communication for marketing purposes, and will not share any aspect of your email communication with any third-party, except where mandated by UAE law and/or International law.3.4
We reserve our right to not respond to your email. Any response we offer is at our sole discretion and is, in its entirety and without exception, the intellectual property of Humanthropy FZCO.3.5
The email communication channel between us is for conversational purposes only, and does not constitute any form of contract or binding agreement between us. Our email communication to you does not constitute any form of emergency support, medical or non-medical advice.

Section 4
Purchasing a service4.1
Mentorship with Dr Bimal is a subscription service that is available exclusively via this Website. The 30-day free trial of the service begins immediately upon activation of a subscription, and is for new customers only. The 30-day free trial is limited to one per customer, and cannot be transferred to, or used by, another person.4.2
All subscription payments are due in full, at the start of each monthly billing cycle. Subscriptions are limited to one per customer, cannot be purchased for, or on behalf of, another person, and cannot be transferred to, or used by, another person.4.3
All subscription payments are processed by Stripe (stripe.com). Please familiarise yourself with Stripe and their Terms of Service prior to activating a subscription. We accept no liability for your interactions with Stripe.4.4
Your payment details will be stored by Stripe, and used for processing payments and refunds. Our access to these details is limited to your name, email address, card type, card expiry date and last four digits of your card number. We use these details exclusively for business administration purposes, and to process refunds. We will not share any of this data with any third-party, except where mandated by UAE law and/or International law.4.5
Our aim is to provide best-in-class services that exceed your expectation at every level. If you feel this has not been the case and would like a refund, please let us know via email. We will not require a reason for the refund. Please note that the refund, processed by Stripe onto your payment card, will be for your most recent transaction, and that refunds are limited to one per customer. No other refunds are offered under any circumstance.4.6
We reserve our right to add, delete or amend any service, including but not limited to details on pricing, at any time, at our sole discretion and without giving reason or prior notice. We also reserve our right to refuse our services to any customer, at any time, at our sole discretion and without giving reason or prior notice, and cannot, under any circumstance, be held responsible for such refusal.

Section 5
Scheduling a session5.1
Sessions with Dr Bimal are scheduled by Cal (cal.com). Please familiarise yourself with Cal and their Terms of Service prior to scheduling a session. We accept no liability for your interactions with Cal.5.2
Any data you share with Cal will be stored on their cloud-based servers, and locally on our Apple devices. We use these details exclusively for scheduling purposes, and will not share any of this data with any third-party, except where mandated by UAE law and/or International law.5.3
If you would prefer a regular day and time for your sessions, this can be arranged via the "recurring sessions" feature on Dr Bimal's Cal page, and is subject to availability of your preferred slot.5.4
During your subscription, you can schedule as many sessions as you wish. We will always endeavour to ensure ample availability of slots, so that you can schedule frequent sessions at short notice. If we feel you are abusing this feature to the detriment of your fellow clients, we reserve our right to terminate your subscription without giving reason or prior notice.5.5
For sessions to take place, an active subscription is required. If you need to cancel a session, there is no penalty for doing so. We kindly request that you endeavour to give as much prior notice as possible for the cancellation.5.6
We have appointed a trusted Clinical Executor, who would have access to your name and email address so they can contact you in an emergency or if, for any reason, Dr Bimal is unable to work with you. In the event of Dr Bimal's death, the Clinical Executor would also be responsible for terminating your subscription with us.

Section 6
Attending a session6.1
All sessions with Dr Bimal take place on a secure video calling platform called Whereby (whereby.com). Please familiarise yourself with Whereby and their Terms of Service prior to scheduling a session. We accept no liability for your interactions with Whereby.6.2
As a digital-first company, we have taken great care to ensure that our interaction with you is through technology that is best-in-class for security, speed and reliability. Please, however, keep in mind that nothing on the Internet is 100% safe, and that there may be factors beyond our control that could, from time to time, interrupt the smooth delivery of our service to you. This includes, but is not limited to, interruptions during our video calls on Whereby.6.3
For each session during your subscription, you will require access to a desktop, laptop or tablet computer with a stable, high-speed Internet connection and an up-to-date version of your web browser (we recommend using Safari or Chrome). Mobile devices are not suitable for the sessions, and are not supported by Whereby in the UAE. Please ensure you have met the above requirements prior to activating your subscription.6.4
Each session will begin and end at the scheduled time, and can be amended only by prior mutual agreement. We conduct our sessions from a private, quiet and well-lit space. For each session, please ensure that you are in a private, quiet and well-lit space, and that your computer is on a stable surface with your video calling camera approximately at eye level. If, for any reason, you feel that your privacy may be compromised, please inform us about that immediately.6.5
All sessions are kept strictly confidential, except for instances where UAE law and/or International law mandates breaking confidentiality, and instances where we discuss aspects of our work with trusted colleagues as part of delivering a professional and ethical service. We do not keep written notes of any session, and we do not make any audio or video recording of any session. Whilst you may wish to keep a journal to support your personal growth journey, you are not permitted to make any audio or video recording of any session, or any part of a session.
